This is an estimate using the Workers' Statute minimums. Your collective agreement or contract may improve it, and the actual reference salary may include other items. Before signing the finiquito, ask a labour lawyer or your union.

How it's calculated

The finiquito is what you're owed when the job ends: the salary for the days worked in the last month, holiday accrued and not taken and, if you're paid in 14 payments, the accrued share of the extra payments. Severance only applies to some kinds of termination and is based on the daily salary and length of service.

Severance under the Workers' Statute

Unfair dismissal: 33 days' salary per year of service, up to 24 monthly payments (art. 56.1). Objective dismissal: 20 days per year, up to 12 monthly payments (art. 53.1.b). End of a fixed-term contract: 12 days per year, pro rata (art. 49.1.c). Fair disciplinary dismissal and resignation: none. For contracts signed before 12 Feb 2012, unfair dismissal adds 45 days per year up to that date and 33 after, capped at 720 days unless the old part alone exceeds it, and never above 42 monthly payments (11th transitional provision).

Conventions used by the calculator

Daily salary for severance = annual salary incl. extras / 365. Daily salary for days worked and holiday = ordinary annual salary (without non-prorated extras) / 365. Years are prorated by months and part of a month counts as a whole month; the 12 days of a fixed-term contract are prorated by days. One monthly payment = 30 days of salary. The summer extra payment accrues 1 July to 30 June and the Christmas one 1 January to 31 December (your agreement may set it differently).
