How rent updates work in Spain

Under article 18 of Spain's Urban Leases Act (LAU), during the tenancy the rent is only updated on each anniversary of the contract and on the terms agreed: without an express update clause, the rent is not updated. Many contracts use the annual change in the general CPI (IPC) of a given month, usually the latest one published on the anniversary date.

The IRAV and Ley 12/2023

Ley 12/2023 on the right to housing, in force since 26 May 2023, amended article 18 of the LAU and asked INE for a reference index for the yearly update of housing rents (IRAV), which acts as the cap on the yearly increase in housing contracts signed since then. INE has published it monthly since 2025, with data from November 2024. Older contracts are updated as their clause says.

How it is notified

Whoever updates the rent must notify the other party in writing, stating the percentage applied; the updated rent is payable from the month after the notice (LAU art. 18.2). The calculator's text is a draft.

This calculator applies the index and month you choose; it does not interpret your contract. Check the update clause and, if in doubt, ask a professional or your local housing office.
